A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.
The situation originates in a erroneous removal to El Salvador in March, which the government later admitted was an mistake. Following his repatriation to the United States to answer human smuggling charges, he was held in federal custody.
In her decision, the court noted that the authorities does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
